On June 17, 2021, the US Supreme Court (Court) dismissed the case challenging the constitutionality of the Affordable Care Act (ACA).

On June 17, 2021, the US Supreme Court (Court) dismissed the case challenging the constitutionality of the Affordable Care Act (ACA). The Court dismissed the case on the grounds that the plaintiffs did not have legal standing to bring the case. As a result, the ACA remains law.
The Court’s Decision
The US Supreme Court dismissed the most recent challenge to the ACA, but in doing so did not rule on the legal questions brought before the Court. Instead, the Court dismissed the case on the grounds that the plaintiffs who were challenging the law’s constitutionality did not have a legal right to sue. The Court’s decision leaves the ACA intact.
Next Steps
Employers do not need to take any action in light of the Court’s decision. The entire ACA, including the health care reporting obligations, remain intact.
